Workplace Training Terms and Conditions

Terms and Conditions  for our experiential workplace training 

1.   Legally binding agreement

1.1    Submission of this booking form constitutes a legally binding agreement subject to the stated terms and agreements

2. Bookings and Confirmation

2.1.  You must complete all details in the booking form.

2.2.  Bookings are confirmed upon receipt of return of this signed booking form.  A tax invoice will be send upon completion of the sessions, or where the sessions are scheduled more than 14 days apart, upon completion of each session.

2.3. Failure to advise Rebus Theatre Inc of the relevant information may affect availability of performances for dates/time frames requested, and reduce the quality of the training experience for participants.

2.4.  It is your responsibility to organise participants to attend training. Rebus Theatre Inc can supply an information sheet to you to be disseminated to employees on request. As the training is based on participation, you must observe the minimum and maximum number of participants per performance, and advise the producer of final numbers prior to performances to assist in the effective delivery of training.

2.5  It is your responsibility to provide Rebus Theatre Inc with information about your training venue, or alternatively, to arrange a venue suitable for the type of training delivery and number of participants attending training.

3. Fees, Charges and Payment

3.1  By submitting this booking form, you are liable for all performance fees and other associated fees which are inclusive of GST as stated in these terms and conditions which include:

3.1.2  Travel costs as agreed or invoiced by Rebus Theatre Inc;

3.1.3  Additional expenses incurred by Rebus Theatre Inc as a result of an extraordinary or non-standard performance installation.

3.1.4  Costs for cancellation of bookings

4.  Cancellation of training and costs incurred.

4.1  Notice period for cancellation of training is three weeks prior to scheduled dates. Cancellation in accordance to this notice will result in a no payable fees or a full refund of fees already paid, subject to clause 4.3

4.2  Cancellation within five working days of scheduled dates will result in you being liable for 50% of performance fees, any additional venue bookings and travelling costs incurred by Rebus Theatre Inc associated with this booking.

4.3 Postponement of the delivery date within three weeks of the original date will result in you being liable for any extra rehearsal and/or administration costs associated with moving the date.

4.4  In unforeseen circumstances should Rebus Theatre Inc cancel a booked performance, you will be provided with a full refund and not incur additional costs associated with the booking.

4.5  Rebus Theatre Inc reserves the right to substitute actors/presenters in performance without notice.

4.6  Rebus Theatre Inc reserves the right to demand and enforce costs pursuant to these terms and conditions, including any associated costs for recovery of outstanding fees and expenses associated with cancellation of bookings.

5.   Legals and Disclaimers

5.1   Other than as required by law, Rebus Theatre Inc makes no warranty of suitability, merchantability or fitness for purpose or warranty that the services or products offered or provided will meet the client’s requirements, nor does Rebus Theatre Inc warrant that the services or products are error free or that their use will be uninterrupted.

5.2  The purchaser assumes responsibility and entire risk as to the suitability and results obtained from use of the products and services, and any decisions made or actions taken based on the information contained in or generated by the products and services

5.3. The total liability of Rebus Theatre Inc   for claims in contract, tort, strict liability or otherwise, including penalties and interest and without limitations, claims regarding the products, services, proposals and representations, or for breach of Rebus Theatre Inc’s obligations hereunder,  shall not exceed the amount equal to the fees paid by the client.  

5.4  To the maximum extent permitted by law, Rebus Theatre Inc  shall not be liable for

(a)  indirect, exemplary, incidental, special or consequential damages or costs , including lost or damaged data, loss of profit or goodwill, whether foreseeable or not, even if Rebus Theatre Inc  has been advised as to the possibility of such damages;

(b) Third party claims against Rebus Theatre Inc or the client; or

5.5  Rebus Theatre Inc  will not be liable for any damages or injury caused by any delay in or failure or defect of performance under this Agreement, or be liable for any other consequences, damage, injury or loss, caused by or resulting from any act, event, occurrence, or cause beyond its reasonable control, including without limitation, failure of telecommunications or Internet services, war, vandalism, sabotage, terrorism, accidents, epidemics, quarantines, fires, explosions, earthquakes, floods, strikes, labour disputes, shortages or delays in obtaining suitable material, labour or transportation, interruption of utility services, acts of any government unit or agency thereof, or acts of the other party, or any similar cause.

5.6   If any provision, clause or sub-clause of these Terms and Conditions is unlawful, void or unenforceable then that provision shall be deemed severable from the remaining provisions and shall not affect their validity and enforceability.

5.6  The Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) provides for certain guarantees.  These guarantees provide the clients with rights that cannot be excluded.  Nothing in this Agreement excludes, restricts or modifies such non-excludable rights and the terms of this agreement are to be read subject to the provisions of the Competition and Consumer Act 2010.

6. Intellectual Property and Copyright

6.1  Rebus Theatre Inc reserves exclusive  intellectual property rights over its training performances and any associated materials produced.  No part of a Rebus Theatre performance or associated materials may be reproduced or sold on without express written permission of Rebus Theatre Inc.

7.  Privacy, Collection and Use of Personal Information

7.1  You acknowledge that personal information concerning you collected or held by us may be used for a variety of purposes including:

(a) to supply goods and services; and

(b) to administer your account and to enforce this agreement

7.2 You agree that if you provide us with personal information about any other individual, you will ensure that the individual is aware regarding the basis their information has been supplied to Rebus Theatre Inc.
